At SW Hot Tub Hire, we value your privacy and are committed to protecting your personal information. This Privacy Policy outlines how we collect, use, and protect the information you provide to us when using our website and services. By accessing or using our website, you agree to the terms of this Privacy Policy.

1. Definitions

a) The 'Business' refers to SW Hot Tub Hire.

b) The 'Hirer' refers to any individual, organisation, or entity hiring equipment from the Business.

c) 'Equipment' refers to the hot tub and all associated items provided by the Business, including accessories and parts required for operation.

d) 'Commencement of Hire' refers to the date the equipment is dispatched to the Hirer.

e) 'Hire Period' or 'Duration of Hire' is the time from the Commencement of Hire until the equipment is ready for collection by the Business (Off-Hire).

f) 'Hire Agreement' refers to these Conditions of Hire, along with any completed hire form, which together constitute the full agreement between the Business and the Hirer.

g) 'Off-Hire' refers to the point when the hire charges cease as determined by the Business.

2. General Conditions

a) The Hirer agrees that the hire of any equipment from the Business is subject to these Conditions of Hire.

b) These terms take precedence over any terms proposed by the Hirer and can only be modified in writing by an authorised representative of the Business.

c) If any clause is deemed unenforceable, the remaining provisions remain valid.

d) The equipment provided for hire is not new and may show signs of previous use.

e) The Business reserves the right to access any premises where its equipment is stored for inspection or retrieval.

f) The Hirer's signature confirms acceptance of these terms and constitutes a legally binding agreement.

g) The Hirer agrees to comply with all laws regarding the use and location of the equipment and will indemnify the Business from any resulting losses, costs, or damages.

3. Payment

a) Hire charges are based on the agreed-upon rates.

b) The Hirer is liable for any costs associated with repossession if the equipment is not returned when required.

c) The Hirer indemnifies the Business against legal and debt recovery fees incurred due to the Hirer breaching this agreement.

4. Ownership and Right of Possession

        a) All equipment remains the property of the Business.
​        b) The Business reserves the right to repossess equipment at any time without prior notice.

        c) Representatives of the Business may enter the Hirer's premises to retrieve equipment without liability for trespass or damage.

5. Damage or Loss

a) The Hirer will be responsible for the cost of repairing or replacing damaged equipment, including associated expenses.

b) The Hire Period will continue until damaged equipment is repaired or replaced.

c) In the event of theft, the Hirer must notify the Business immediately and provide a detailed report, including a police notification.

d) The Hirer is responsible for any loss of equipment or accessories.

e) If the hired spa is punctured during the rental period, a flat fee of $500 will be charged to the payment method provided at the time of booking.

6. Hirer's Responsibilities

a) The Hirer agrees to use the equipment only as intended by the manufacturer.

b) Any malfunction or failure must be reported to the Business immediately.

c) Charges will continue until the Hirer covers repair or replacement costs for damages caused by negligence.

d) Equipment must be returned clean and in good condition. Additional charges may apply if this condition is not met.

e) Equipment must not be used for unlawful or unsafe purposes.

7. Business Responsibilities

a) The Business will provide equipment in clean, functional condition.

b) Operating instructions will be provided upon request.

c) Liability for breach of implied conditions is limited to repair or replacement of equipment.

8. Insurance

The Hirer is responsible for maintaining adequate public liability insurance for the premises where the equipment is used. The Business is indemnified against claims arising from damage, injury, or financial loss related to the use of the equipment.

Important Safety Information

The use of alcohol, drugs, or medication before or during hot tub use can increase the risk of hypothermia or other health issues. Pregnant women, individuals with pre-existing medical conditions, and those on medication should consult a physician before use. Excessive water temperatures (above 38°C) can pose serious health risks.
